Earlier this year, WRAL reported a DWI charge resulting in a fatal Raleigh wreck. 16 year old Garrett Prince was driving his
Jeep with 17 year old Elizabeth Molloy in the passenger seat. The police report states the Jeep was traveling at 75 mph in a 30 mph zone. Witnesses saw the Jeep run up on the curb, crash into a mailbox and hit a tree. Molloy died that night. Prince was taken to the hospital and treated for injuries. He is now facing several charges, including:
- provisional DWI
- careless and reckless driving
- having an open container of liquor
- speeding
- possession of marijuana
Driving While Intoxicated is a dangerous and expensive way to pass time. It costs lives. Getting charged with a DWI is taken very seriously in North Carolina. You can get a DWI if you drive with a blood alcohol concentration (B.A.C.) at 0.08% or higher. However, because Prince is under 21, his minimum B.A.C. is 0%. North Carolina is a “zero tolerance” State.
Penalties for DWI Charges:
- For a first arrest (lifetime); if the offender has B.A.C. of .14 or lower, there was no accident with personal injury or more than $500 property damage, the offender might qualify for ADETS (Alcohol and Drug Education Traffic School). This is the shortest (16 hours) and cheapest ($160) level that can be required by the DWI Assessment.
- For an offender with a previous arrest: the individual may be required to attend a minimum of the 20/30 hour, 40/60 hour or 90 hour group classes.
- If breathalyzer reading is .16 or more, you will be required to have Interlock installed on your car as well as possibly receive probation as part of your sentencing.
- One year license suspension for a first offense
- One to Four years license suspension and four days in jail for a second offense
- One year to permanent license suspension and 14-30 days in jail for a third offense
